The Nebraska Fair Housing Act protects the right any person with a disability to obtain, use and enjoy the housing of their choice absent discrimination. Housing providers and operators are required to consider a request for a person with a disability to have a reasonable accommodation (changes in the rules, policies and practices), or reasonable modification (structural changes made at the expense of the person with the disability). The person protected under the Act has a physical or mental impairment that substantially limits one or more of their major life activities, or has a record of such impairment, or is regarded as having such an impairment, but does not include any person who has current or illegal use of a controlled substance. The person protected could be a buyer or renter, or any person associated with the buyer or renter, or any person residing in or intending to reside in the dwelling after it is sold, rented, or made available. Housing providers and operators are not expected to make housing available to any person whose tenancy would constitute a direct threat to the health or safety of others; or whose tenancy would result in substantial physical damage to property.

Any person that has been convicted in court for the illegal manufacture or distribution of a controlled substance does not have protection under the Act, and any person who attempts to coerce, intimidate, threaten, or interfere with any person in the exercise of their fair housing rights is in violation of the Act.
