The Nebraska Fair Employment Practice Act and the Americans With Disabilities Act Amendment Act of 2008 prohibit discrimination in employment on the basis of disability, being regarding as disabled, or a record of disability. An individual with a disability must be qualified to perform the essential functions of the job, with or without accommodation, in order to be protected by the law. Reasonable accommodation is any change to a job or work environment that allows a qualified applicant or employee with a disabilty to participate in the application process, to perform the essential functions of the job, or to enjoy benefits and privileges of employment equal to those enjoyed by employees without disabilities.

An employer is required to provide a reasonable accommodation to a qualified applicant or employee with a disability unless the employer can show that the accommodation would be an undue hardship, that is, it would require significant difficulty or expense.
